Mesothelioma-Stricken Teacher Wins Legal Victory

A Pennsylvania teacher has won a legal victory, which may impact thousands of mesothelioma victims and their families. The core of the settled issue was whether a state employer is responsible for workplace safety. Another issue involving whether the state was liable for damages related to asbestos exposure in 1959 was left to a future court to settle.

Pittsburgh School District Schools

Marianne M. Geier worked for the Pittsburgh School District during the 1958-1959 academic year. During this time, numerous overhead pipes in the classrooms were noted to have coverings which flaked and crumbled. The covering was asbestos and the crumbling was the material becoming friable.

It was not until 1964 that research proved a link between asbestos and cancer. However, anyone in those classrooms during that time would have been exposed to asbestos dust, making them strong candidates for mesothelioma.

Outcome

Given the number of possible victims of asbestos exposure demonstrated from this single case, the school district fought to have this case removed from the system. The Commonwealth Court of Pennsylvania heard arguments in May 2017 and decided in favor of the defendant Mrs. Geier. This small victory could lead to big victories for others.

In making its arguments to dismiss the case, the school district attempted to disclaim responsibility for the safety of its employees. The court disagreed and ruled that the case may proceed through the system.
