The Colgate-Palmolive Lawsuit

This case began when a woman who used Cashmere Bouquet talcum powder, which was manufactured by Colgate-Palmolive, was diagnosed with the mesothelioma disease. She and her husband sued Colgate-Palmolive based on several legal theories. They claimed that the product was not manufactured correctly, that the talcum powder did not meet consumer expectations and that that Colgate-Palmolive failed to warn users about the dangers of talcum powder. Negligence and a risk-benefit liability claim were also asserted.

The jury found that Colgate-Palmolive was the main defendant responsible and awarded a $13 million verdict in favor of the couple. The verdict included damages for malice. The jury only deliberated for a few hours before finding that Colgate-Palmolive was 95 percent responsible for the pain and suffering of the woman and for other damages.

Sadly, victims often die within two years of the onset of the disease and suffer greatly while they are living with mesothelioma. Asbestos cases against other manufacturers continue across the country.
