New Jersey Asbestos Lawyers: Recent Asbestos Removal Violation Case

Certified Environmental Services Inc., a New York asbestos abatement testing company, recently pled guilty in federal court to negligence for releasing asbestos into the atmosphere.  The charge is a misdemeanor offense for negligent endangerment violations due to fact that the company performed air sampling and lab analysis from 1999-2007 for two clients’ asbestos abatement projects.

The plea bargain deal sets forth that the company faces probation, restitution and a fine of up to $200,000 for how they conducted samples and analysis.  The case against the company found the employees failed to do the following:

  1.  Visually inspect asbestos debris and pools of water on the site
  2.  Comply with mandatory waiting periods before administering tests
  3.  Properly calibrate pumps prior to and following sampling
  4.  Properly perform air sampling
  5.  Properly perform decontamination of air samples and equipment

Additionally, the company allowed contractors to collect air samples for them, which is strictly prohibited.

Illegal Removal of Asbestos

The clients they worked with, AAPEX Environmental Services Inc. and Paragon Environmental Services Inc., both plead guilty to conspiracy charges and payed over $80,000 in restitution in early court cases. Both of these companies were found to have illegally removed asbestos in what industry experts call “rip and run” removal at Syracuse University, LeMoyne College, public schools, government facilities and businesses.

When this type of illegal removal is performed, the workers strip and remove the asbestos dry and leave it scattered behind in various locations in the work area. When this happens, asbestos is able to migrate outside of the work environment. With no level of asbestos exposure being deemed safe, and contact considered severely toxic, it is imperative that abatement companies take the utmost caution in its removal.
