New Jersey Asbestos Lawyers discuss Trial Award for Exposure to Asbestos in Talcum

In Los Angeles, California a jury has awarded a 73 year old woman $13 million for contracting mesothelioma from Colgate’s Cashmere Bouquet talcum powder. The verdict includes $1.4 million for the plaintiff’s husband. This case could hold substantial impact as it may open asbestos litigation to consumers, wherein asbestos-related cases to this point have involved workers who have contracted asbestos-related diseases from working with the carcinogenic substance.

The jury found the company negligent for failing to warn consumers of the substantial danger of the product and negligent for the design, manufacture and sale of the product. Talc does not typically contain asbestos. However, some talc has reportedly been extracted from mine deposits contaminated with asbestos.

The defendant in the case, Colgate, has announced disappointment with the verdict. They argued the facts and evidence presented in the case showed no link between their product and the plaintiff’s illness. That being said, Colgate elected to avoid a lengthy appeals process by agreeing to a confidential settlement with the plaintiff.

In related consumer product asbestos information, several years ago the FDA conducted a study of cosmetics containing talc and found no asbestos. However, some studies have demonstrated a possible association between talc powders and ovarian cancer, although a link between the two is not conclusive.
